Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Trendsetter Labs ("we", "us", "our") governing your access to and use of the Trendsetter AI website, applications, APIs, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter contracts. By using the Service you represent that you meet these requirements and that all information you provide is accurate. The Service is not directed at residents of jurisdictions where its use would be unlawful.

3. Educational Use Only — Not Financial Advice

Trendsetter AI is an educational, research, and analytical tool. Nothing on the Service constitutes financial, investment, tax, accounting, or legal advice, an offer or solicitation to buy or sell any security, derivative, currency, or other financial instrument, or a recommendation of any specific trading strategy.

All AI-generated output (including but not limited to chart analyses, "entries", "stops", "targets", lessons, trade evaluations, chat responses, market commentary, sentiment, news summaries, and economic calendar interpretations) is for informational and educational purposes only. You are solely responsible for evaluating the merits and risks of any decision and for any actions you take in your brokerage or exchange account.

Trading and investing involve substantial risk of loss, including loss of principal. Past performance is not indicative of future results. You should consult a licensed financial professional before making any investment decision.

4. AI Output & Accuracy Disclaimer

The Service uses third-party large language models and vision models. AI output may be incomplete, biased, out of date, factually wrong, or "hallucinated". Charts may be misread. Prices, indicators, levels, and news items may be inaccurate or delayed. You must independently verify every output before acting on it. We make no warranty that the Service or any output will be accurate, reliable, error-free, complete, or available without interruption.

5. Accounts & Security

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at support@trendsetterlabs.com of any unauthorized access. Account sharing is prohibited. We may suspend or terminate accounts that violate these Terms or pose a security or fraud risk.

6. Subscriptions, Credits & Billing

The Service offers a free account with trial credits and paid subscription plans billed monthly in U.S. dollars through Stripe, Inc. By subscribing you authorize us (and Stripe) to charge your selected payment method on a recurring basis until you cancel. Prices, plan inclusions, and credit allowances are displayed on the pricing page and may change with notice.

Credits: Each plan grants a monthly credit allowance. Credits are consumed by AI actions (chart analysis, lessons, voice, trade evaluation, etc.). Unused credits may roll over for one month and otherwise expire. Credits have no cash value and are not refundable or transferable.

Cancellation & Refunds: You may cancel at any time from Settings or by emailing support. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer refunds or credits for partial billing periods, unused credits, or unused time. Where required by law, statutory refund rights are preserved.

Failed Payments: If a payment fails, we may suspend access and retry the charge. Repeated failures may result in cancellation.

Taxes: Stated prices are exclusive of taxes. You are responsible for any applicable VAT, sales tax, or similar charges.

7. Affiliate Program

If you participate in the affiliate program, you agree to the additional terms displayed in your affiliate dashboard, including commission rates, payout minimums, attribution windows, and prohibited promotion methods (no spam, no misleading claims, no self-referrals, no incentivized fraud). We may withhold or reverse commissions tied to fraudulent, refunded, or chargeback transactions. Payouts are processed through Stripe Connect, subject to Stripe's terms.

8. Acceptable Use

You agree not to: (a) reverse engineer, decompile, scrape, or copy the Service or its output at scale; (b) use the Service to provide regulated financial advice to third parties or to operate a competing trading-signal service; (c) upload unlawful, infringing, or malicious content; (d) attempt to bypass rate limits, authentication, billing, or credit systems; (e) use the Service to generate content that violates applicable law; (f) share your account; (g) abuse, harass, or threaten our staff or other users; or (h) interfere with the Service's operation.

9. User Content & License

You retain ownership of charts, screenshots, prompts, trade journals, and other content you upload ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display User Content solely to operate and improve the Service for you. We do not sell your User Content and we do not use it to train third-party AI models. You represent that you have all rights necessary to submit your User Content.

10. Intellectual Property

The Service, including software, design, text, lessons, branding, and the "Trendsetter AI" name and logo, is owned by Trendsetter Labs or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, lawful trading and educational use.

11. Third-Party Services

The Service integrates third-party providers including Stripe (payments), Supabase (hosting/auth/storage), OpenAI, Google, and Anthropic (AI models), TradingView (chart data), and analytics/error-tracking providers. Your use of those features is also subject to those providers' terms. We are not responsible for third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT TRADING USING THE SERVICE WILL BE PROFITABLE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRENDSETTER LABS, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST TRADING OPPORTUNITIES, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD OR (B) USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Trendsetter Labs from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your trading activity, or your breach of these Terms.

15. Termination

You may close your account at any time from Settings. We may suspend or terminate your access immediately for breach of these Terms, suspected fraud, abuse, or risk to the Service or other users. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You and Trendsetter Labs waive any right to a jury trial and to participate in a class action, to the extent permitted by law.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be announced in-product and/or by email. Your continued use of the Service after changes take effect constitutes acceptance.

19. Signal Hub and AI-Generated Analysis

Trendsetter AI provides an educational feature called Signal Hub which displays AI-generated chart analysis derived from automated TradingView indicator alerts. By accessing Signal Hub you agree to the following:

1. Educational Purpose Only. All content in Signal Hub including AI grades, confidence scores, directional analysis, reference price levels, and reasoning summaries is provided solely for educational and informational purposes. Nothing in Signal Hub constitutes financial advice, investment advice, or a recommendation to buy or sell any financial instrument.
2. Not a Registered Adviser. Trendsetter AI LLC is not a registered investment adviser under the Investment Advisers Act of 1940, nor a registered Commodity Trading Adviser under the Commodity Exchange Act.
3. Risk of Loss. Trading financial instruments involves substantial risk of loss. You may lose some or all of your capital.
4. No Liability. Trendsetter AI, its owners, employees, contractors, and affiliates bear no responsibility for any trading losses or financial harm arising from your use of Signal Hub.
5. No Performance Guarantee. Historical AI grades and confidence scores are not indicative of future results.
6. Your Responsibility. You are solely responsible for all trading decisions. Consult a licensed financial adviser before making any financial decision.
7. Jurisdictional Compliance. You are responsible for ensuring that accessing Signal Hub complies with the laws of your jurisdiction.
8. Acknowledgment. By accessing Signal Hub you confirm you have agreed to these terms and are accessing this feature solely for educational purposes.

20. Broker Integration & Auto-Execution (TradersPost, MetaApi, and Similar)

Trendsetter AI offers optional integrations with third-party broker-connectivity providers (including TradersPost and MetaApi) that allow AI-generated signals to be transmitted to a brokerage account you own and control. By connecting a broker or enabling auto-execution you acknowledge and agree that: (a) you alone own the brokerage account and are solely responsible for all orders placed in it, whether initiated manually, by Trendsetter AI, or by a third-party bridge; (b) Trendsetter AI is not a broker, dealer, futures commission merchant, introducing broker, or money manager, and does not hold or handle your funds; (c) auto-execution features are provided in Beta on an "as is" basis and may misfire, miss signals, size incorrectly, submit stale orders, fail to close positions, or otherwise behave unexpectedly due to network issues, broker downtime, symbol mapping errors, API changes, or bugs; (d) you are responsible for setting appropriate position sizing, risk limits, and safeguards at your broker and for monitoring open positions; (e) you authorize Trendsetter AI to transmit orders, read account balances, positions, and fills, and to store this data solely to operate the Service; and (f) you release Trendsetter AI and its integration partners from any liability for losses arising from executed, unexecuted, partially executed, delayed, duplicated, or erroneous orders. You may revoke broker access at any time from Settings.

21. Hypothetical & Simulated Performance Disclaimer (CFTC Rule 4.41)

Any performance results, backtests, grades, win-rates, confidence scores, historical signals, leaderboard entries, or example trades displayed on the Service are hypothetical or simulated unless expressly labeled as a live executed trade in your own account. Hypothetical or simulated performance results have many inherent limitations. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. There are frequently sharp differences between hypothetical performance results and actual results subsequently achieved by any particular trading program. One limitation of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading, including but not limited to the ability to withstand losses or adhere to a particular trading program in spite of losses.

22. Market Data, Charts & Third-Party Content Authorization

The Service displays market data, charts, symbols, economic calendar events, news headlines, sentiment summaries, and other financial information sourced from third parties including TradingView, chart-image providers, and public data feeds. This content is provided for informational and educational display within the Service under our agreements or the third parties' publicly available terms, is provided on a delayed or "as available" basis, is not guaranteed to be accurate, complete, or timely, and may not be redistributed, scraped, resold, or used to build a competing product. You agree that your use of third-party market data through the Service is subject to those providers' terms and that Trendsetter AI is not liable for any errors, omissions, delays, or interruptions in that data. All third-party trademarks, tickers, and logos remain the property of their respective owners; their display on the Service does not imply endorsement.

23. User Uploads, Voice, and Consent to AI Processing

By uploading charts, screenshots, images, journal entries, trade data, or by using voice features (speech-to-text and text-to-speech), you expressly authorize Trendsetter AI to (a) transmit that content to third-party AI providers (including OpenAI, Google, Anthropic, and their sub-processors) for the sole purpose of generating your requested output, (b) store the content and resulting output in your account, and (c) use de-identified, aggregated data derived from the Service to monitor quality, prevent abuse, and improve the Service. You represent that you have all rights necessary to upload the content and that it does not contain material you are not authorized to submit (including confidential broker statements of third parties, other people's identifying information, or copyrighted material you do not have rights to use). We do not sell your personal data, and we do not permit third-party AI providers to train their public foundation models on your prompts or uploads where those providers offer such controls.

24. Public Content, Feed & Leaderboard Authorization

If you post to the community feed, comment, react, share a trade, opt into a leaderboard, use a display name, avatar, or affiliate creator profile, or otherwise submit content intended to be visible to other users or the public, you grant Trendsetter AI a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, reproduce, display, distribute, modify (for formatting, moderation, and translation), and promote that content within and in marketing of the Service. You waive any moral rights to the extent permitted by law. You are responsible for the content you post and agree not to post anything unlawful, defamatory, harassing, misleading, or infringing. We may moderate, hide, or remove content at our discretion without notice.

25. Testimonials, Screenshots & Marketing Use

Testimonials, reviews, trade screenshots, and results shown on the Service and in marketing materials reflect the individual experiences of the persons depicted, are not typical, are not guarantees of future results, and may have been submitted in exchange for a free or discounted subscription or other consideration. Where required, such testimonials are so labeled. If you submit a testimonial, review, or trade screenshot to us, you grant Trendsetter AI the right to use, edit for length and clarity, and display it (with your first name and last initial, or handle) in marketing across any channel indefinitely, unless you revoke the license in writing to support@trendsetterlabs.com.

26. No Fiduciary or Advisory Relationship

Nothing in these Terms, the Service, any AI output, any lesson, any live session, any 1:1 support interaction, any community post, or any communication from Trendsetter AI staff, contractors, or affiliates creates a fiduciary, advisory, brokerage, agency, partnership, joint venture, or employment relationship between you and Trendsetter Labs. All information is educational and general in nature and does not take into account your personal financial situation, objectives, or risk tolerance.

27. Communications & Electronic Consent

By creating an account you consent to receive transactional and service-related communications from Trendsetter AI (including billing, security, product, and support emails and in-app messages) electronically, and you agree that electronic communications, agreements, and notices satisfy any legal requirement that such communications be in writing. You may opt out of non-essential marketing emails at any time via the unsubscribe link.

28. Copyright & DMCA

Trendsetter AI respects intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to support@trendsetterlabs.com including: (a) a physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) the URL or location of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act. We may remove content and terminate repeat infringers.

29. Export Controls & Sanctions

You represent that you are not located in, under the control of, or a national or resident of any country subject to a comprehensive U.S. embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export-control and sanctions laws in your use of the Service.

30. Force Majeure

Trendsetter AI is not liable for any failure or delay in performance caused by events beyond our reasonable control, including internet or network outages, third-party API or model outages, broker downtime, cloud provider failures, cyberattacks, denial-of-service events, government actions, labor disputes, natural disasters, or pandemics.

31. Assignment, Severability & Entire Agreement

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect and the unenforceable provision will be modified to the minimum extent necessary. These Terms, together with the Privacy Policy and any plan-specific or feature-specific terms presented in-product, constitute the entire agreement between you and Trendsetter Labs regarding the Service and supersede all prior agreements and understandings.

32. Final Acknowledgment

BY CREATING AN ACCOUNT, SUBSCRIBING, CONNECTING A BROKER, OR OTHERWISE USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS, INCLUDING THE EDUCATIONAL-ONLY NATURE OF ALL AI OUTPUT, THE RISK OF LOSS IN TRADING, THE LIMITATIONS OF AUTO-EXECUTION, THE HYPOTHETICAL-PERFORMANCE DISCLAIMER, AND THE LIMITATION OF LIABILITY, AND YOU AGREE TO BE LEGALLY BOUND BY THEM.
